Thank Christ. Senate falls one vote short of approving the proposed amendment to allow Congress to regulate against flag-burning (which would likely have whistled through enough of the state legislatures).
Can this piece of shit rear its head again in a matter of weeks or months, or do they have to leave it wait for a time?

I think that burning people is far more expressive myself. I agree, Smug. It is dumbfuckery at its best. However, I should say that if burning the American Flag is to be considered a form of free speech (which it should be), then burning any flag should be considered an expression of free speech. The problem is, I am not so sure it quite works that way.
If you burn one of those gay rainbow flags to protest a gay pride parade, or burn a Mexican flag to protest illegal immigration, etc., I don't know that you wouldn't end up arrested or sued for committing a hate crime.
All I can say is that dumb legislation is dumb legislation, but it is dumb all the way around.

I would think that prosecution for burning any flag wouldn't survive the Supreme Court either. I don't see how it could given the two rulings that the USSC has handed down on flag-burning before now.
I guess that burning a flag could be a crime in some other sense but the mere fact of burning a flag is protected speech, I think, other factors aside.

I suspect that you are correct. I do, however, think that there are double standards on both sides the issue. The who free speech thing is rife with such.

By 'free speech' I suspect that many people mean 'speech that doesn't offend me'.
They should perhaps work on finding things less offensive.

Evan Bayh: For it.
McConnell (R)(KY): Against it (!)

Harry Reid: For it.

Most of the rest were not really surprising, or at least didn't jump out at me. All in all, 14 Democrats whored themselves out to vote for it. Only three Republicans broke ranks to vote against it (McConnell, Chaffee, and...Bennett (UT)(wtf)). Round of applause for the Democrats that resisted the easy urge, and the three Republicans.
Reid, McCain, and Arlen Specter can all kiss my ass. I even sent Specter a letter on this issue months ago!

Seems that the Dems in vulnerable districts whored themselves in a big way. Lieberman included, though he whored the other way for obvious reasons. Perhaps they did so with the knowledge that the chamber had the votes to defeat it despite their defections. But what's Feinstein's excuse?
Or, here's a thought: did McConnell and Bennett, both in relatively safe seats, throw their votes to the other side in a deliberate decision to keep the issue alive for the midterms?

This issue is perhaps the greatest test of a person's conception of what America stands for. Anyone who thinks we should ban flag burning (with a constitutional amendment, no less) clearly doesn't really comprehend the principles that our country supposedly stands for.

They should have passed an amendment that makes people immune from prosecution for beating up a flag burner...I think we would all be happy with that.

And what the fuck are the GOP up to, fighting to add the USA to the noble list of countries that have laws against burning the national flag (a list including, I believe, Iran and Cuba).
The UK has a stupid law against defacing the image of the monarch; it's pretty stupid, but at least it's based on a person (I say again, it's a stupid old law).
