They cannot deprive you of breath just for you eluding them. The gist of the story from witnesses and his lawyer is that he did not struggle after being taken down until the cop put his knee on his neck and cut off his breath. Of course, the video doesn't show the whole chase and takedown, so where the truth lays is in question in this case.
By the way, sleeper holds, which used to be used by police, have been ruled illegal because it sometimes leads to choking the suspect to death from strangulation. Extrapolate from that, asshole.
Personally, I do not have a problem with police using physical force to arrest someone, as long as the force used is reasonable and proportionate. When cops continue to beat a suspect after he is on the ground and no longer fighting or a risk to the officer's safety is where I draw the line. I have been on the end of that scenario before, and I would have sued the pants off the policeman if it hadn't been for the incompetence of the attorney I went to.
